This policy describes how we collect, use and disclose your information when you use our application, and your privacy rights. By using the Service, you agree to the collection and use of information in line with this policy.
StumpMike (the "Application" or "Service") is operated by Utterlysocial Media Solutions Private Limited ("Utterly Social", "we", "us"), B-603, Tower 2, Aspen, Godrej Woodsman Estate, Bangalore 560024, Karnataka, India.
Personal Data you give us may include your email address, first and last name, phone number, bio, address (state/province, ZIP/postal code, city) and language preference.
Usage Data collected automatically may include your device's IP address, browser type and version, the pages you visit, the date, time and duration of visits, unique device identifiers and diagnostic data. On a mobile device this may also include the device type, device ID, IP address, mobile operating system and mobile browser type. We may also collect information your browser sends when you use the Service.
Information collected while using the app, with your permission, includes your location (city, state and country), which we use to provide and customise features. This may be uploaded to our servers or a Service Provider's server, or stored on your device. You can enable or disable it at any time in your device settings.
We keep your Personal Data only for as long as necessary for the purposes set out here, and to comply with our legal obligations, resolve disputes and enforce our agreements. Usage Data is generally retained while you have an account, and longer where needed to strengthen security or functionality, or where we are legally required to.
Your information may be processed at our offices and anywhere the parties involved are located — including outside your state, country or jurisdiction, where data-protection laws may differ. Your consent to this policy, followed by your submission of information, represents your agreement to that transfer. We take all steps reasonably necessary to keep your data secure, and won't transfer it to an organisation or country without adequate controls in place.
The security of your Personal Data matters to us, but no method of transmission over the internet or electronic storage is 100% secure. We use commercially acceptable means to protect it, but cannot guarantee its absolute security.
Our Service does not address anyone under the age of 16, and we do not knowingly collect Personal Data from anyone under 16. If you are a parent or guardian and believe your child has provided us with data, please contact us — if we learn we have collected it without parental consent, we take steps to remove it. Where your country requires parental consent, we may require it before collecting and using that information.
The Service may contain links to sites we do not operate. We have no control over, and assume no responsibility for, the content or privacy practices of any third-party site. We strongly advise you to review the privacy policy of every site you visit.
We may update this policy from time to time. We will post the new version on this page, let you know by email and/or a prominent notice before it takes effect, and update the "Last updated" date. Changes are effective when posted, so please review this page periodically.

These Terms of Use ("TOU") govern your use of StumpMike, provided by Utterly Social. By using the app — other than to read these terms for the first time — you agree to all of them. Utterly Social may update the TOU at any time without notice.
Using the app means you agree to comply with these terms, including any supplemental terms that govern specific features. Your right to use the app is personal to you and not transferable. You are responsible for all use of your account (under any screen name or password) and for keeping your password(s) confidential. Utterly Social may change or discontinue any aspect or feature of the app — including content, hours of availability, and the equipment needed for access — at any time.
Utterly Social may change or modify these terms, or impose new conditions (including adding fees and charges), at any time. Such changes take effect immediately upon notice, which may be given by posting in the app, by electronic or conventional mail, or by any other means. Any use of the app after notice is deemed acceptance of the changes.
Through the app, Utterly Social provides access to a variety of resources — including a platform to post voice messages, discuss cricket in a controlled setting, download areas, communication forums and service information (the "Services"). Any updates, enhancements and new features are subject to these terms.
You are responsible for obtaining and maintaining all telephone, computer hardware, software and other equipment needed to access and use the app, and for all charges related to it.
The Services may include email, bulletin boards, chat areas, news groups, forums, communities, personal pages and audio or message facilities (each a "Communication Service"). Use them only to post and receive proper, relevant messages. You agree that you will not:
Utterly Social has no obligation to monitor the Communication Services, but reserves the right to review and remove materials, and to terminate your access at any time, without notice, for any reason. It may disclose information to satisfy any law, regulation or government request. Always use caution sharing personal information. Utterly Social does not control or endorse content in the Communication Services and disclaims liability for it; managers and hosts are not authorised spokespersons.
If a Service requires an account, you must provide current, complete and accurate registration information, and choose a password and username. You are entirely responsible for keeping your password confidential and for all activity under your account, and must notify Utterly Social immediately of any unauthorised use or breach of security. Utterly Social will not be liable for losses caused by someone else using your password or account, but you may be held liable for losses caused to Utterly Social or others. Do not use anyone else's account without the holder's permission.
Any software available to download is the copyrighted work of Utterly Social and/or its suppliers, and its use is governed by the accompanying licence agreement. Reproduction or redistribution not in accordance with that licence is prohibited and may result in severe civil and criminal penalties. The software is warranted, if at all, only according to its licence; otherwise all warranties and conditions — including merchantability, fitness for a particular purpose, title and non-infringement — are disclaimed. Any tools and utilities are provided with no assurance about the accuracy of their results; please respect others' intellectual-property rights.
Permission to use documents (such as white papers, press releases, datasheets and FAQs) is granted provided the copyright notice appears on all copies, use is for informational, non-commercial or personal purposes only (not copied onto any network or broadcast), and no modifications are made. Accredited educational institutions may download and reproduce documents for classroom distribution; distribution beyond the classroom requires written permission. Documents are provided "as is" without warranty of any kind, may contain technical inaccuracies or typographical errors, and may be changed at any time; all warranties are disclaimed.
In no event will Utterly Social or its suppliers be liable for any special, indirect or consequential damages, or any damages whatsoever resulting from loss of use, data or profits — whether in contract, negligence or other tortious action — arising out of the use or performance of software, documents or services, or the failure to provide them.
Utterly Social does not claim ownership of the materials you provide or post (each a "Submission"). However, by posting a Submission you grant Utterly Social, its affiliates and necessary sublicensees permission to use it in connection with their internet businesses — including to copy, distribute, transmit, publicly display and perform, reproduce, edit, translate and reformat it, to publish your name with it, and to sublicense these rights. No compensation is paid, and Utterly Social is under no obligation to post or keep any Submission and may remove it at any time. You warrant that you own or control all rights to your Submission. For images, you also warrant that you own the copyright or have permission, that you have the rights to grant these licences, and that anyone depicted has consented; by posting images you grant a non-exclusive, worldwide, royalty-free licence to use them as permitted by these terms. The licences end when you completely remove the material, without affecting licences granted beforehand.
Your use of StumpMike is at your sole risk. The app is provided on an "as is" basis without warranties of any kind, express or implied, including title, merchantability and fitness for a particular purpose (other than those that cannot be excluded by law). Utterly Social is not liable for any damage or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay, computer virus, communication-line failure, theft, destruction, or unauthorised access or alteration — whether for breach of contract, negligence or any other cause — and specifically is not liable for the defamatory, offensive or illegal conduct of other users; that risk rests entirely with you. In no event will Utterly Social be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the app, nor for any errors, inaccuracies, omissions or third-party claims or losses. Any market or pricing information is not investment advice — verify with a professional before acting on it. Force majeure: neither party is responsible for failure or delay due to circumstances beyond its reasonable control (including acts of God, war, riot, embargoes, civil or military acts, fire, floods, accidents, and equipment, software, power, network or telecommunications failures); the affected party will give notice within fifteen (15) days, and performance is suspended for the duration of the event.
Links in the app may take you to sites that are not under Utterly Social's control; Utterly Social is not responsible for their content, links, changes or transmissions, and provides links only as a convenience — inclusion of a link does not imply endorsement. Utterly Social is a distributor (not a publisher) of content supplied by third parties and users, with no more editorial control than a public library, bookstore or newsstand. Opinions, advice and statements expressed by third parties are their own, not Utterly Social's, and their accuracy, completeness or usefulness is not guaranteed. It is your responsibility to evaluate any content, and to seek professional advice where appropriate.
Utterly Social does not accept or consider unsolicited ideas — including ideas for advertising campaigns, promotions, new products or technologies, processes, materials, marketing plans or product names. Please do not send any original creative artwork, samples, demos or other works. The purpose of this policy is to avoid potential misunderstandings or disputes. If you send ideas or materials despite this request, Utterly Social makes no assurance that they will be treated as confidential or proprietary.
Utterly Social has the right, but not the obligation, to monitor the content of the app — including chat rooms and forums — to determine compliance with these terms and any operating rules, and to satisfy any law, regulation or authorised government request. It may, in its sole discretion, edit, refuse to post or remove any material, including anything it finds to be in violation of these terms or otherwise objectionable.
You agree to defend, indemnify and hold harmless Utterly Social, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses — including attorneys' fees — arising out of your use of the app or your account.
Either Utterly Social or you may terminate this agreement at any time. Utterly Social may immediately terminate your account in the event of any conduct it considers unacceptable, or any breach of these terms.
These terms, together with any operating rules established by Utterly Social, are the entire agreement between the parties and supersede all previous agreements on the subject. They are governed by the laws of Bangalore, India, without regard to conflict-of-laws rules. No waiver of any breach is a waiver of any preceding or subsequent breach. The StumpMike logo is a trademark of Utterly Social; all rights reserved. All other trademarks are the property of their respective owners. Any rights not expressly granted here are reserved.
